Depp claims that the escalation of events in Australia was because Amber was not happy about a post nuptial agreement. He writes in his UK witness statement, “Miss Heard had a conversation with my then lawyers, Bloom Hergott, who explained to her my intention to enter into a post-nuptial marital agreement to protect my assets. She was enraged that there would be a post nuptial agreement“.
Depp's claim is an obvious attempt to paint Amber as a 'gold-digger'. However, Amber was already in the process of arranging a pre-nup which became a post-nup after the wedding on 3rd February 2015.
In Depp’s UK testimony he says, Amber was upset about a pre-nup meeting.
In the US Depp says,” I had called my lawyer at the time and asked him if he could have one of his lawyers sit down with Miss Heard and give her a basic rundown of what a post-nuptial agreement meant“.
Depp later adds, “Ms. Heard told me that the attorney that she met with was rude and dismissive.”
At the time Depp claims the meeting took place, Amber was filming in London. She flew directly from London to Australia. Bloom Hergott have offices in L.A. Amber did not fly to L.A. during this time.
Depp’s lawyer, Jacob Bloom testified that he did not remember meeting with Amber Heard. Ben Chew moved to block this testimony.
Depp’s story is also problematic because Amber had already hired Michelle Mulrooney to handle the pre-nup. Talks between her attorney and Depp’s were in progress.

Amber finishes filming in London and starts her journey to Australia.
Lowy emails Mulrooney, “Dana Lowy e-mails Michele Mulrooney: “Hi Michele: Thank you for forwarding the Confidentiality Agreement. I have now signed. Please sign and also please date for Amber and forward a fully executed copy to me. We will be back in touch. Best, Dana.”
5th March 2015
Mulrooney’s assistant emails her to confirm that Lowy has completed the confidentiality agreement. Shortly after this Depp calls Mulrooney.
Mulrooney testified that Depp on 5th March 2015 Depp spoke to her on the phone. She said he called her a ‘bitch’ and fired her. The post-nup was never completed.
Amber recalls an argument regarding the post-nup but attributes her aggravation to Christi’s (Depp’s sister) underhand way of achieving it. It is clear from attorney emails that Amber was in the process of finalising the document.
DRUGS AND ALCOHOL
Depp’s claim that he did not take drugs in Australia conflicts with texts he was sending to Nathan Holmes in which he asked him to procure ecstasy and cocaine. Note that Depp asks to be ecstatic ‘again’ insinuating that this is a repeat request.
Depp also had Marilyn Manson visiting prior to Amber's arrival. More texts mention his drug requests.
In the UK trial Depp claimed to have been sober for 18 months. This was proved to be untrue with the message he sent to Paul Bettany describing his drugs and alcohol consumption just 10 months before the Australian incident.
AMBER'S VERSION OF EVENTS
Amber describes a very detailed three day assault. On her arrival she describes Depp saying, “He was very thin, which is typically a sign that he has been using”.
Because of filming schedules, the pair had not seen each other in a while so Amber describes her frustration at finding that Depp wanted to drink alcohol. She writes in her witness statement, “I wanted to connect with him but he just seemed to want to drink. At some point he took out a bag of MDMA (ecstasy), and I guess I had some sort of negative reaction to that."
An argument starts and Amber claims that Depp pushed, shoved and slapped her then took some MDMA. Amber goes to bed leaving Depp alone.
The next day Amber claims that she came downstairs to find that Depp has continued to drink and there are very few MDMA left in the bag which Depp had been holding the day before. She tries to make some food but another argument breaks out and continues throughout the day.
Amber describes the attack which involves Depp sexually assaulting her with a bottle. Eventually Amber says she went to bed and took sleeping pills prescribed by Dr Kipper.
The next day Amber writes in her statement that she comes downstairs the next day to find Depp had severed the tip of his finger and urges him to call security.
DEPP'S VERSION
In Depp’s version of events he completely denies a 3 day altercation. Depp claims in his UK witness statement that any argument they had relating to the Australian incident was restricted to the 8th March 2015.
Remember, this is contradicted by Michelle Mulrooney who testified that she received a call from Depp a few hours after an email she sent on 5th March 2015 (LA time) which would be a day later Australia time.
Depp doubles down on the date in his cross examination by Sacha Wass claiming the argument was entirely restricted to the 8th March 2015.
What both testimonies agree on is that Depp was in the bar drinking. This would be understandably bothering to Amber. It would make sense that Amber would try to stop Depp from drinking.
Both Depp’s testimony and Amber’s testimony agree that there was broken glass. Amber claimed to have cuts caused by being forced down onto the shattered glass on the counter top. Photos taken later show the scars on her arms.
On the audio recording dated 8th March 2015 Jerry Judge says that she had scratches on her arms and “she’s got a bruise, she’s got a bruise underneath“.
Property Manager Ben King said, “I did notice on one arm she had marks which looked like cuts.“
DEPP'S FINGER
Amber was asked how she thought Depp might have cut his finger. She speculated that it might have happened when he was smashing the wall mounted phone.
In the UK Depp admitted he ripped the phone off the wall.
In the US Depp claimed there was no phone on the wall.
Depp admitted to cutting his own finger in both audio when talking directly to Amber and in texts to both Dr Kipper and Nurse Erin.
Audio – Depp talking to Amber: “I’m talking about Australia. The day that I chopped my finger off“.
Audio – Amber talking to Depp: “Exactly! Because you’re bigger and your’re stronger. And so when I say that I thought you could kill me, that doesn’t mean you counter with you also lost your own finger“.
Text to Dr Kipper: I cut the top of my middle finger off.. What should I do!?? Except, of couse, go to hospital.
Text to Dr Kipper: I have chopped off my left middle finger as a reminder that I should never cut my finger off again!!
Text to Nurse Erin: Ol’ Kipper… this is my second time that he’s held off givin me meds by blackmailing me in to seeing him.. The first time I had just chopped my finger off.
There isn't one contemporaneous text, email or audio recording of Depp ever claiming that Amber cut his finger. There is no record of Depp claiming that Amber injured his finger. This new story only emerges after she files for divorce.
In his UK Witness statement Depp claims the bottle “smashed against” his hand.
Depp claimed that Amber threw a bottle which exploded near his hand which was palm down on the bar. With his hand palm down, the underside of his finger tip is cut off. There is no record or photographs showing any other cuts or scratches to his hand.
Depp also claimed that Amber put a cigarette out on his face although she doesn't smoke.
Depp's own doctor testified that Depp reported that he cut himself and burned himself with cigarettes.
Another discrepancy arises with Dr Kipper’s testimony. He claims that Depp told him he cut his finger holding his hands up to protect his face. This is a different story from the one Depp told. Presumably for this reason, Dr Kipper’s testimony in this instance was not used.
WHERE WAS THE FINGER FOUND
There seems to be a conflict in the testimony of Dr Kipper and Ben King about where the finger was found. Ben King said the finger was found downstairs in the bar.
Dr Kipper says the finger was found upstairs in the kitchen.
WHAT WAS AMBER DOING WHILE DEPP TRASHED THE HOUSE?
What is interesting about Depp’s testimony is that he fails to mention what Amber did immediately after his finger was injured. Given everything we know about Amber from his own account of her following him around it seems unlikely that she would simply stand and watch him paint deranged messages all over the house with his bloody stump for hours. It seems even more unlikely that she would simply watch while he painted all over her art work in her studio or threw pain on all her clothes. Depp offers no suggestions to where Amber was or what she was doing during this time.
In Amber’s account of the incident she states that she went upstairs and took sleeping pills and never saw Depp until she woke hours later.
In Amber’s witness statement she writes that she saw all the devastation upon waking up and coming downstairs finding Depp injured. At this point Amber says she urged Depp to call for security to help him.
Eventually security arrives and Depp is taken to hospital. It’s worth noting that Depp could have called for help at any time. It is only when Amber is back in the picture that help is summoned.
