THE INCIDENT
On the 21st May 2016 after Amber and Depp had been separated for one month, Depp comes to visit Amber at the penthouse at 7.02pm. An argument begins and Depp loses his temper throwing a phone at Amber's face.
While talking, Depp becomes angry about the dog poo on the bed and accuses Amber’s friends of being responsible.
Amber first calls Savannah so she can deny the accusation and put Depp’s mind to rest. She doesn’t answer so she calls texts Raquel Pennington and iO Tillet Wright.
DEPP'S CLAIM
Depp claimed that the whole incident was a set up and that Raquel was hiding in the closet. Texts show that Amber contacted her by text at 20.06 asking her to come over. This is an hour after Depp arrived.
iO calls Amber and laughs at the ludicrous suggestion that he is responsible for the faeces in the bed. He wasn’t even there that day. This makes Depp even more angry. iO hears the altercation on the phone and shouts at Amber to get out of the apartment. He texts Raquel then calls the police.
Raquel doesn't see the text immediately. When she does she goes to the Penthouse (along the corridor) but forgets her keys. She returns to her penthouse then comes back with the keys and lets herself in. Raquel see's Amber with her face in her hands. She places herself between Depp and Amber to stop him from getting any closer to her.
For Depp's claim to be true, Raquel would have to have been hiding in the closet for nearly an hour and a half.
Depp leaves at 8.29pm. The CCTV shows Depp looking agitated and pacing the elvator.
THE POLICE
The police arrive. Officer Hadden and Officer Saenz both testify that Amber’s face was red. In the absence of any knowledge about Depp throwing the phone at Amber, they attribute this to crying.
Procedure dictates that the police officers should have filed a report. They neglected to do this which may explain their reluctance to admit that the redness they saw was an injury rather than from crying.
Officer Saenz gives Amber a card with a telephone contact number to call should she need it.
Raquel takes several photos of the bruising as it develops.
The next day, Amber goes with Rocky to a Bead Show. A photo is taken of her with sunglasses on to hide the bruising.
Amber then delivers a cake to her friend, Amanda De Cadenet’s birthday party. Amanda later sends Amber a text telling her to use arnica cream on the bruising and to take photos.
DEPP'S APOLOGY TEXT
Next day, Depp sends an apology text to Amber and lets her know he wants to call her to talk.
RESTRAINING ORDER
On 27th May 2016 Amber files for a temporary restraining order which is granted by Judge Carl H Moor. At this point Depp is leaving the country but the restraining order would be in place on his return. Amber is photographed outside the court with bruising on her face. Depp’s team later accuse Amber of staging the photographers. However, in a 2016 interview to the New Yorker, founder of TMZ Harvey Levin stated that he had three full time reporters stationed at the court house permanently to be first to hear of any celebrity gossip.
DEPP'S ADMISSION TEXT
On hearing the news of the restraining order, Depp sends a text to Amber’s mother. He downplays the incident saying he just ‘lobbed’ the phone over his shoulder and that he had no idea that she ‘wouldn’t just catch it, or that it would land on the couch’. This shows two things. Depp admits he threw the phone. The phone was not caught. It hit Amber.
DEPP'S ADMISSION AUDIO
In a telephone recorded by Depp without Amber’s knowledge, Depp accuses Amber of telling iO to call the cops:
DEPP: You told io to call the cops
AMBER: I did not call the cops and I did not give them any statement when they came. I’ve been trying to protect you.
DEPP: iO called the cops
AMBER: When? When it was happening? (The assault)
DEPP: Yeah!
AMBER: Oh, I’m sorry! I’m sorry because the last time that it got crazy between us, I really did thing I was gonna lose my life, and I thought you would do it on accident!
Later on in the same conversation Amber explains to Depp why she screamed for iO to call the police…
AMBER: Exactly, because you’re bigger and you’re stronger and so when I say that I thought you could kill me, that doesn’t mean you counter with YOU ALSO LOST YOUR OWN FINGER! I am not trying to attack you here. I’m just trying to point out the fact of why I said, ‘call 911’. Because you had your hands on me after YOU THREW A PHONE AT MY FACE!
CONCLUSION
- Depp is seen leaving the scene looking agitated.
- iO heard the attack and called the police.
- Police saw the redness (beginning of a bruise) on Amber's face.
- A photograph next day shows the bruising
- Amber's friend Amanda texts referencing the bruising
- Depp sends an apology text
- Depp sends a text to Amber's mother admitting he threw the phone at Amber
- Depp admits in audio that the assault happened.
